Health data is a special category
Information about a member's health, such as injuries noted at intake, is sensitive data under the GDPR. Processing it is generally prohibited unless a specific exception applies, so it needs the strongest protection, in your systems and in your backups. [1]
Fingerprint access is almost always prohibited
The Autoriteit Persoonsgegevens says biometric access control is almost always prohibited. With explicit consent it can be allowed, but you must actively offer customers another way in, such as a pass, and carry out a DPIA first. [2]
Seven years for a club's books
Book 2 of the Dutch Civil Code obliges the board of a legal entity to keep its books, documents and other data carriers for seven years. Records may be moved to another medium if they stay complete and readable for that whole period. [3]
Seven years for a gym's tax records
For a commercial gym, membership fees, direct debits and invoices are part of the basic administration that the Belastingdienst requires you to keep for seven years. [4]
NIS2: sport is not a listed sector
Fitness and sport are not among the sectors the Cyberbeveiligingswet covers, the Dutch NIS2 law in force since 15 August 2026. Micro and small organisations outside the listed sectors are in principle out of scope; the GDPR's breach reporting duty does apply. [5]
When it goes wrong
A treasurer's account taken over
Illustrative example: the volunteer treasurer of an amateur football club keeps the membership export, the contribution overview and the sponsor contracts in the club's Google Workspace. A phishing email gives an attacker access, the shared drive is emptied and the account locked. Because the club's Google Workspace was backed up by Mindtime, the board restores the shared drive to its state before the attack and resets the account. The board then assesses whether the breach must be reported to the Autoriteit Persoonsgegevens.

Before you switch
What fitness centres and sports clubs ask us first
We are a volunteer club without an IT budget.
Then losing the administration hurts most, because nobody is paid to rebuild it. Start small with the club's Microsoft 365 or Google Workspace, which you can try free for 7 days, and add the treasurer's laptop. Every backup job is checked, so volunteers do not have to watch it.
Our member software already stores everything.
It stores what is inside that system, on the supplier's terms, so check its export and retention options. Intake forms, contracts, emails, rosters and spreadsheets usually live elsewhere. Mindtime protects those in its own data centres in the Netherlands and Germany.
Where will our members' data be stored?
Only in Mindtime's own Tier III data centres in the Netherlands and Germany. Transfers are encrypted with AES-256, admin actions require MFA, and a data processing agreement is part of every contract.
FAQ
Questions about backup for fitness centres and sports clubs
What data should a gym back up?
Member contracts and cancellations, payment and direct debit overviews, intake questionnaires, trainers' notes, staff rosters and the mailbox where members write in. Some of this sits in your member software; much of it lives in email, spreadsheets and folders. Back up the workspace, the laptops and any NAS, and export overviews from cloud software regularly.
Can intake forms with health information go into a backup?
A backup is a copy of the same data, so the same rules apply: protect it as well as the original and keep it no longer than you need. Mindtime encrypts data in transit with AES-256, requires MFA for admin actions and is audited against ISO 27001 and NEN 7510, the Dutch standard for information security in healthcare.
How does a sports club keep data from walking out with volunteers?
Move club files out of personal accounts into a club Google Workspace or Microsoft 365 tenant, so the data belongs to the club rather than the volunteer. Then back that tenant up. When a volunteer steps down, the files stay, and if someone deletes a folder by mistake, it can be restored from Mindtime's copy.
Does NIS2 apply to fitness centres?
No, not as a sector: fitness and sport do not appear among the NIS2 sectors that the Dutch Cyberbeveiligingswet has covered since 15 August 2026. What does apply is the GDPR, including the duty to report a breach of member data to the Autoriteit Persoonsgegevens within 72 hours, and a backup is part of being able to recover from one.
