What the rules ask of bailiffs (gerechtsdeurwaarders)

  1. Continuity of automated systems

    Article 5.14 of the Gerechtsdeurwaardersverordening, in force since 1 February 2023, says the bailiff makes an effort to secure the continuity and integrity of the automated systems used in the office, and takes measures to protect access to systems and data. [1]

  2. Seven-year retention of office records

    Article 18 of the Gerechtsdeurwaarderswet requires office administration records to be kept for the period in Article 2:10(3) of the Dutch Civil Code, which is seven years. Article 17 adds that the register and repertorium must be properly consultable. [2]

  3. Confidentiality of what you learn

    Under Article 3.5(4) of the Gerechtsdeurwaardersverordening, a bailiff keeps secret the information obtained in office whose confidential nature they know or should reasonably suspect. [1]

  4. Supervision by BFT

    Bureau Financieel Toezicht (BFT) supervises bailiffs under the Gerechtsdeurwaarderswet. According to the government's business portal, BFT looks at finances, integrity and quality, and a KBvG-appointed auditor checks quality every three years. [4]

  5. Not a NIS2 sector

    Bailiff services are not in the sector list of the Cyberbeveiligingswet, which implements NIS2 in the Netherlands and applies from 15 August 2026. Your continuity duty comes from the professional rules above instead. [6]

When it goes wrong

A failed update before a busy day

Illustrative example: the case management server of a regional bailiff office will not start after an update, on a day with several seizures planned. The local copy on the server's second disk turns out to be damaged as well. The office restores the server and its case database from Mindtime's checked, immutable backups, or starts it on standby infrastructure if it has disaster recovery. Field staff keep their laptops' files, because those were backed up too.

    You can show the data processing agreement, Mindtime's ISO 27001 and NEN 7510 audit status, and the results of your own restore tests. That gives a concrete answer to questions about continuity of automated systems.

Questions about backup for bailiffs (gerechtsdeurwaarders)

How long do bailiff offices need to keep backups?

At least as long as your office records must be kept, which is seven years under the Gerechtsdeurwaarderswet. The verordening also asks you to destroy documents once their retention period has expired, so agree a backup retention period that matches your archiving policy rather than keeping everything indefinitely.

Is our data stored outside the Netherlands?

Mindtime stores data only in its own Tier III data centres in the Netherlands and Germany, so it stays within the EU. Data is encrypted in transit with AES-256, admin actions need MFA, and every contract includes a data processing agreement.

What does disaster recovery add to backup?

Backup brings data back; disaster recovery keeps the office running. Mindtime keeps standby infrastructure on which your servers can be started if your own hardware is lost. A first test failover is typically done within 10 days, and quarterly DR tests show it still works.
